How Long Does a Father Have to Establish Paternity in California?

In California, the time frame for establishing paternity depends on various factors, including the marital status of the parents and whether the father acknowledges his paternity voluntarily.

  • If the parents are unmarried: A father can establish paternity at any time. However, the process should ideally be initiated soon after the child’s birth to ensure that the father's legal rights are recognized. If the father and mother do not voluntarily sign a Voluntary Declaration of Paternity (VDOP), either party may request a court order to establish paternity.
